Ninth Circuit Wrong Again - Navy Sonar Case

Posted by Cominius in November 13th 2008

In a decision entered Wednesday, the Supreme Court overturned decisions of the U.S. District Court for he Central District of California, affirmed by the Ninth Circuit Court of Appeals. In plain and unmistakable language Chief Justice Roberts, writing for the majority stated: The Court of Appeals was wrong and its decision is reversed. and the District Court abused its discretion.

The controversy at issue:

The District Court entered a preliminary injunction prohibiting the Navy from using MFA sonar during its training exercises. The Court of Appeals held that this injunction was overbroad…

Posted by Cominius in November 11th 2008

90 years past, at the 11th hour of the 11th day of the 11th Month 1918, the guns of World War 1 fell silent. It is our privilege and honor today to pay tribute to all those who served under the American colors then and now. Serving today in Operation Iraqi Freedom are the 2nd and 4th Brigade Combat Teams, the Aviation Brigade and the 3rd Sustainment Brigade of the 3rd Infantry Division. This tribute is to that division and all who have served and are recognized this Veteran’s Day. The 3rd Infantry Division was activated in November 1917 for service in the First World War, taking up positions…

GM Going Going …

Posted by Cominius in November 10th 2008

Maintaining a position of implausible deniability as has become common, President-elect Barack Obama declined to say if he supported an appeal by Senator Harry Reid and Representative Nancy Pelosi to rescue General Motors and the U.S. auto industry. Instead of taking a position, Mr. Obama permitted his newly appointed chief of staff, Rahm Emanuel to urge swift action to rescue the auto industry commenting to ABC:

“As president-elect Obama has said throughout the campaign and as I think as recently as Friday … the auto industry is an essential part of our economy and an essential part of…

Obama Reneging Already: No to Drilling/Yes to Energy Dependence

Posted by Cominius in November 9th 2008

John Podesta, leader of Mr. Obama’s transition team appeared on Fox News Sunday. Mr. Podesta, asked to describe what was at the top of an Obama administration priority list noted:
Senator Obama said that he wanted all the Bush executive orders reviewed, and decide which ones should be kept, and which ones should be repealed, and which ones should be amended.

Asked to be specific about the kind of executive orders Mr. Obama might want to change, Mr. Podesta observed:

I think across the board, on stem cell research, on a number of areas, you see the Bush administration even today moving…

Emanuel: Accounting Fraud Overseer

Posted by Cominius in November 8th 2008

Representative Rahm Emanuel (D-IL), President-elect Obama’s selection for chief of staff, presided over massive accounting fraud at Freddie Mac while serving on that company’s board of directors, ABC News reports. The ABC report notes that the Securities and Exchange Commission found that the entire Freddie Mac board, including Mr. Emanuel “failed in its duty to follow up on matters brought to its attention.” Those matters include misreporting profits by billions of dollars in order to deceive investors between 2000 and 2002. These fraudulent activities led the SEC to charge Freddie Mac with…

With a new Administration: Whither Health Care?

Posted by Cominius in November 7th 2008

The Democratic Party and its supporters, along with President-elect Obama have made health care issues a major talking point in their campaign. It may be of value to consider what elements of policy would make up a solution to the health care crisis which was proclaimed. That crisis was described in terms of 47 million uninsured, soaring health care costs, and lack of access to affordable health care.

From a Federalist perspective, there is no role at all for the federal government in health care. It is generally not interstate commerce, few people see a doctor or pharmacist or go to a…

Medvedev’s Instant Challenge to Obama

Posted by Cominius in November 6th 2008

The Associated Press reports on a speech by Russian President Dimitry Medvedev which followed the election of Senator Barack Obama to the presidency by less than 24 hours. A key point of the speech was an announcement that Russia would deploy offensive and missiles between Germany and Poland in response to deployment of defensive missiles in Poland, a NATO member country.

The announcement is clearly meant as an immediate challenge to President-elect Obama. If the new administration chooses to ignore the challenge, west leaning countries like Ukraine, and Poland will need to reconsider their…

Obama: To Oath or not to Oath

Posted by Cominius in November 6th 2008

It appears Senator Barack Obama will take the oath of office as the 44th President of the United States on January 20, 2009. The Constitution requires that before the president enter on the execution of his office, he shall take the following oath or affirmation:

“I do solemnly swear (or affirm) that I will faithfully execute the office of President of the United States, and will to the best of my ability, preserve, protect and defend the Constitution of the United States.” (Article II Section 1)

What is unclear is whether this new president can honestly take such an oath.

In our previous…

Obama, Osama, and that Iranian Fellow

Posted by Cominius in November 3rd 2008

Again we return to the CNN Wolf Blitzer interview with Senator Barack Obama.

The CNN Transcript includes the following exchange:
BLITZER: Senator McCain says that, if he’s elected president, Iran will not become a nuclear power. Can you make that same commitment?

OBAMA: Well, I have said I will do everything in my power to prevent Iran from obtaining nuclear weapons.

I think it would be a game-changer. It would not be acceptable. It would be a threat to our strongest ally in the region, Israel. But it would potentially trigger a nuclear arms race in the region. And we have to both apply…

Obama on Osama: Oh Mama

Posted by Cominius in November 3rd 2008

In an interview with Wolf Blitzer, CNN, Senator Barak Obama makes a very interesting and revealing comment about his plans for Osama Bin Laden.

I will focus on what Secretary Gates and others have indicated is our number-one security threat. And that is bin Laden and al Qaeda. We will go after him. We will kill him, or we will capture him, try him, apply the death penalty to him, where it is necessary.
If Osama bin Laden is captured, tried and convicted, Senator Obama believes the death penalty should be applied to him where it is necessary. Just what does the “where it is necessary” mean?…

What Obama voters believe - Hope vs. Reality

Posted by Cominius in November 2nd 2008

After hours of discussion along the political trail this season, I have tried to synthesize what democratic voters imagine will happen next year if Barack Obama is elected along with increased democratic majorities in the Congress. I have also tried to reconcile these imaginings to the realities these voters appear to have willfully overlooked.

Iran:
Hope: Iran and its president will be so exuberant over the prospect of sitting down with a President Obama without precondition that they will give up their nuclear weapons program, agree to peace with Israel, cut off funding for Hezbollah in…

Obama’s Insurance Mandates: Silence about Enforcement

Posted by Cominius in November 1st 2008

Senator Obama’s health care plans include two significant mandates.

a. Parents must insure their children

b. Employers must insure their employees.

The significance of these mandates is in deciphering how they are to be enforced. During his debate with Senator McCain, Senator Obama state that no small employers (small = 3, 5, 1000 employees?) would be fined but coverage will still be mandated. How is this possible unless the mandate is to be enforced by some measure other than a fine. There are other measures. The business could be ordered to cease operations, the employer could be jailed…

Democrat Logic: Photo ID needed to vote, no; see Obama, yes

Posted by Cominius in October 31st 2008

The Associated Press reports that Georgia Democrats are appealing a Fulton County Court ruling that upholds the requirement for voters to present photo id to vote. Voting is important, and the rules being protested were put in place by Congress to ensure that each eligible voter has an equal opportunity to vote only once.

On the other hand attending a Senator Barack Obama rally, while it may be desirable for some, is not as significant politically as actually voting. One would think the requirements for attendance with the One would be similarly reduced. We have evidence that they are not….

Obama: Whiner or Winner?

Posted by Cominius in October 30th 2008

In the Opinion Journal article Barack Wrote a Letter, the Wall Street Journal ridicules Senator Obama’s toothless letter to Secretary Paulson and Fed Chairman Bernacke that Senator Obama cited as “action” to save the American people and economy from the banking crisis. The acts of salvation Senator Obama requested were:

a stirring call to “assess options”
a bold suggestion to “facilitate a serious conversation”
a Churchillian proposal to get various interest groups together to “consider” best practices in mortgage lending.

Frequently in campaign speeches, Senator Obama has described his…

Black Liberation Theology, Marxist Redistribution, Obama

Posted by Cominius in October 28th 2008

What does the underlying black liberation theology of Reverend Jeremiah Wright’s church, Marxism, and Senator Obama’s desire to spread the wealth have in common? Everything.

Consider the following:

As SWAC Girl notes in her written text of the video we posted yesterday, Senator Obama’s zeal to ’spread the wealth’ are simplified code words for his position that the redistribution of wealth is a cornerstone of political and economic justice. In his 2001 statement Senator Obama decried the failure of the Civil Rights movement to use community organizing and activities to put together actual…
